Article 1 – Organizing Companies
Best of Both Worlds (BOBW), a simplified joint stock company (SAS) with a capital of 5000 euros, registered with the Melun Commercial Register under number 844112516, with its registered office at 621 Av. Blaise Pascal
77550 Moissy-Cramayel and Warner Music France, a simplified joint stock company (Société par Actions Simplifiée) with a capital of 87,000,000 euros, registered with the Paris Trade and Companies Register under number 712 029 370, with its registered office at 118 rue du Mont Cenis – 75018 PARIS (WMF), hereinafter collectively referred to as the "Organizers", are organizing a game with purchase obligation in connection with the commercial release of the album "Florescence" by artist Maisie Peters (the "Artist"), hereinafter referred to as the "Game".
Article 2 – Purpose
2.1 The Game will be accessible from the website available at the following URL: https://wminternationalstore.fr/collections/maisie-peters, hereinafter the "Page").
2.2 The Game will be promoted through an advertising campaign and a newsletter launched by Warner Music France.
2.3 The Game starts on March 13, 2026, and will end on March 18, 2026, at noon.
2.4 The status of winner is subject to the validity of the participant's participation (the "Participant").
2.5 Participation in the Game implies unreserved acceptance of these rules in their entirety (the "Rules"), the ethical rules in force on the Internet, as well as the laws, regulations, and other texts applicable in France. The Rules therefore apply to any Participant who participates in the Game.
Article 3 – Conditions of participation
3.1 Participation in the Game is open to any natural person residing in France and at least 18 years old on the date of their participation, who has purchased a "Florescence" album on the Page.
3.2 In addition to persons not meeting the above conditions, the following persons may not participate in the Game:
i) corporate officers and employees of the organizers, of any company controlled by the organizers, which controls the organizers, or under common control with the organizers;
ii) persons who have collaborated in the organization of the Game as well as their family members (spouses, partners, direct ascendants, and descendants).
3.3 The organizers reserve the right to ask any Participant to justify the above conditions and to declare null and void any participation from a Participant who does not meet these conditions.
3.4 One participation per natural person (same name, same postal address, same email address) is authorized for the Game for the entire duration of the Game.
Article 4 – Game Procedure
4.1 To participate in the Game, the Participant must visit the Page and follow the steps below:
1°/ The Participant must purchase a "Florescence" album on the Page
3°/ The Participant must carefully read and accept these Game Rules. By purchasing an album, the Participant accepts these Game Rules.
4.2 It is specified that the information communicated by the Participant in the context of the Game will be used in accordance with BOBW's data processing policy, which can be consulted via the Page.
Validly registered Participants will be drawn on Wednesday, March 18, 2026, by BOBW to try to win the prizes described in Article 6 below.
Article 5 – Winner Selection
5.1 The winner is selected by a random draw by BOBW, from among the Participants meeting the conditions of participation specified in particular in Article 3 of the Rules.
5.2 The random draw will be automatically performed by BOBW software on March 18, 2026, to designate 10 winners (hereinafter referred to as the "Winners"). The Winners will be awarded the prizes described in Article 6 of these Rules.
5.3 10 potential substitute winners (hereinafter referred to as the "Substitute Winners") will also be designated. In the event that it turns out after verification that the Winner did not meet the eligibility requirements, did not comply with the conditions of these Rules, does not wish to claim their prize, or their contact details are unusable (incomplete, erroneous, etc.), the latter will forfeit their prize to a Substitute Winner, under the conditions referred to in this article.
5.4 Winners will be contacted after the draw from March 18, 2026, to inform them of their success and the procedures for obtaining their prize.
Article 6 – Prize Awarding
6.1 Each of the 10 Winners will be awarded the following prize ("Prize"):
2 invitations to the listening session (preview listening) of the artist's album "Florescence" which will take place on March 22 in Paris (hereinafter the "Prize").
As this is a non-commercialized prize, no value can be indicated.
The Event address will be communicated to the Winners by email.
6.4 Notwithstanding the foregoing, the Organizers reserve the right to replace the Prize with any prize of equivalent value if necessary.
Article 7 – Limitation of Liability
7.1 Participation in the Game implies knowledge and acceptance of the characteristics and limitations of the Internet, particularly concerning technical performance, response times for consulting, querying, or transferring information, risks of interruption, and more generally, risks inherent in any connection and transmission over the Internet, the lack of protection of certain data against possible misuse, and risks of contamination by possible viruses circulating on the network.
7.2 Consequently, the Organizers cannot under any circumstances be held responsible, without this list being exhaustive:
for the content of the services consulted on the Page and, in general, for all information and/or data disseminated on the services consulted on the Page;
for the transmission and/or reception of any data and/or information on the Internet;
for any malfunction of the Internet network preventing the proper conduct/operation of the Game;
for the failure of any reception equipment or communication lines;
for the loss of any paper or electronic mail and, more generally, for the loss of any data;
for routing problems;
for the operation of any software;
for the consequences of any virus, computer bug, anomaly, technical failure;
for any damage caused to a Participant's computer;
for any technical, material, and software failure of any kind, which prevented or limited the possibility of participating in the Game or damaged a Participant's system.
7.3 It is specified that the Organizers cannot be held responsible for any direct or indirect damage resulting from an interruption, a malfunction of any kind, a suspension or the end of the Game, for any reason whatsoever, or for any direct or indirect damage that would result, in any way, from a connection to the Page. It is up to each Participant to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any infringement. The connection of any person to the Page and the participation of Participants in the Game is under their sole responsibility.
Article 8 – Agreement on Proof
8.1 It is agreed that, except in the case of manifest error, the organizers may rely, particularly for the purpose of proving any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a computer or electronic nature, format or medium, established, received or stored directly or indirectly by BOBW, particularly in its information systems.
8.2 Participants undertake not to contest the admissibility, validity or probative value of the aforementioned elements of a computer or electronic nature, format or medium, on the basis of any legal provision whatsoever which would specify that certain documents must be written or signed by the parties to constitute proof.
Thus, the elements considered constitute proof and, if produced as evidence by the organizers in any contentious or other proceedings, they will be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document that would be established, received or stored in writing.
Article 9 – Amendment of the Rules
9.1 The organizers shall not be held liable if, due to force majeure or circumstances beyond their control, the Game must be modified, shortened, or canceled.
In all cases, they reserve the right to extend the participation period and to postpone any announced date.
Any modification to the Rules will come into effect upon its online publication, and any Participant will be deemed to have accepted it by the mere fact of their participation in the Game, from the effective date of the modification. Any Participant refusing the modification(s) must cease participating in the Game.
9.2 The Organizers reserve the right to take legal action against anyone who has defrauded or attempted to do so. However, they shall not incur any liability whatsoever towards the Participants due to any fraud that may have been committed.
9.3 Fraud will include, in particular, a Participant registering and then participating in the Game under one or more fictitious names or names borrowed from one or more third parties, each Participant being required to register and participate in the Game under their own unique name. Any fraud will result in the elimination of the Participant.
9.4 In the event of a breach by a Participant, the Organizers reserve the right to automatically exclude any participation from the latter, without the latter being able to claim anything whatsoever.
Article 10 - Personal Data
The contact details of all Participants will be used in accordance with the provisions of General Data Protection Regulation No. 2016/679 of the European Parliament and of the Council ("GDPR") and the "Data Protection Act" of January 6, 1978, in its current version.
Each Participant has (under the conditions and limits provided by laws and regulations) a right of access, rectification or erasure of information concerning them, or restriction of the processing of information concerning them, or objection to this processing, or a right to portability of their information. Each Participant has the right, if they consider that the processing of their personal information violates applicable laws and regulations, to lodge a complaint with the CNIL.
Article 11 – Applicable Law and Interpretation
11.1 The Rules are exclusively governed by French law.
11.2 Any question regarding the application or interpretation of the Rules, or any unforeseen question that may arise, will be decided sovereignly by the Organizers in compliance with French legislation.
Article 12 – Consultation of the Rules
12.1 The complete Rules can be consulted and printed.
